Terms of Use

1. Acceptance of Terms
By accessing or using the Upslang platform (“Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not access or use the Service. These terms constitute a legally binding agreement between you and Upslang (Italy).
You must be at least 16 years old to use Upslang.
2. The Service
Upslang provides an AI-powered preparation platform for language certification exams, currently focused on Cambridge English (B1 Preliminary, B2 First, C1 Advanced). The Service includes realistic exam simulations, AI-generated evaluations and feedback, and progress tracking tools.
Important: Upslang is an independent preparation tool and is not affiliated with Cambridge Assessment English, Cambridge University Press & Assessment, or any official examination body. Completing simulations on Upslang does not constitute passing or sitting an official Cambridge examination.
To improve the Service, we collect behavioral analytics including usage patterns, exam performance metrics, and — with your consent — session recordings via Microsoft Clarity. Full details are set out in our Privacy Policy and Cookie Policy.
3. Your Account
- •You are responsible for providing accurate and up-to-date information at registration.
- •Each account is strictly personal and for individual use only. Account sharing — including sharing login credentials with any other person — is not permitted.
- •To enforce this policy, we monitor access patterns. Accounts accessed from more than 3 distinct network locations within any 24-hour period may have access temporarily restricted. If you are blocked in error, contact hello@upslang.com.
- •You are responsible for keeping your login credentials secure. Notify us immediately of any unauthorized access at hello@upslang.com.
- •We reserve the right to suspend or terminate accounts that violate these Terms.
- •You may request deletion of your account at any time by contacting hello@upslang.com. Deletion requests are processed within 30 days, subject to any data retention obligations set out in our Privacy Policy.
4. Payment & Access Plan
Access to the Upslang Cambridge preparation suite is provided via a one-time payment of €29, which grants 12 months of full access from the date of purchase.
Payments are processed securely by Lemon Squeezy. Upslang does not store your payment card details. You will receive a payment confirmation by email.
There is no automatic renewal. You will receive an email reminder before your access expires. At expiry, your account remains active but exam access is suspended until you choose to renew.
Fair use limits: To ensure equitable access for all users, AI-powered evaluations are subject to the following limits: a maximum of 10 evaluations per day and 60 evaluations per month, with a minimum interval of 5 minutes between consecutive evaluations. These limits are generous for normal preparation use and reset automatically at midnight UTC (daily) and on the 1st of each month (monthly). If a limit is reached, further evaluation requests will be temporarily declined until the counter resets. No exam history, account data, or subscription status is affected.
Data retention after expiry: Your exam results and evaluations are retained for 60 days after your subscription expires. After this grace period, exam data is permanently deleted from our systems. Your account identity (name and email) is not affected and remains available for re-subscription.
5. Refunds & Right of Withdrawal
Under EU consumer law (Directive 2011/83/EU), you generally have a 14-day right of withdrawal from digital content purchases. However, by completing the checkout process and requesting immediate access to the Service, you expressly consent to the immediate delivery of digital content and acknowledge that you lose your right of withdrawal once access is granted and you have started using the Service (Art. 16(m) of Directive 2011/83/EU). This consent is captured via a dedicated confirmation step at checkout.
Exception: If you have not yet submitted any exam simulation, you may request a full refund within 14 days of purchase by contacting us at hello@upslang.com. We will process refunds within 14 days to your original payment method.
6. Acceptable Use
You agree not to:
- •Share your account credentials or allow others to access the Service using your account.
- •Circumvent technical measures designed to enforce these Terms, including account session limits.
- •Reproduce, distribute, or commercially exploit any part of the platform or its content without written permission.
- •Attempt to reverse-engineer, decompile, or extract the source code of the platform.
- •Use automated tools (bots, scrapers, crawlers) to access or interact with the Service.
- •Submit content that is offensive, illegal, or infringes the rights of others.
- •Submit writing texts exceeding 600 words per section in a single evaluation request.
- •Attempt to circumvent access controls, payment systems, or security features.
- •Use the platform in any way that could damage, disable, or impair the Service.
7. Intellectual Property
All content on the Upslang platform — including but not limited to exam simulations, questions, instructions, design, software, and AI evaluation systems — is the exclusive property of Upslang and is protected by copyright and other intellectual property laws.
You retain ownership of your original written submissions (essays, letters, etc.). By submitting content for AI evaluation, you grant Upslang a limited, non-exclusive licence to process that content solely for the purpose of delivering the evaluation service.
8. AI Evaluations Disclaimer
AI-generated evaluations are provided for educational purposes only. They are designed to simulate feedback aligned with Cambridge Assessment criteria, but they are not official assessments and do not guarantee any specific outcome in a real examination.
AI evaluations may contain errors or inconsistencies. Upslang makes no warranty regarding the accuracy, completeness, or reliability of AI-generated feedback.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, uninterrupted availability, or freedom from errors. We do not guarantee that use of the platform will result in improved exam performance or certification success.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Upslang's total liability for any claim arising out of or related to these Terms or the Service shall not exceed the amount you paid in the 12 months preceding the claim. Upslang is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud, or for any liability that cannot be excluded under Italian or EU consumer law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy and applicable EU regulations. For disputes involving EU consumers, mandatory consumer protection provisions of your country of residence apply regardless of this choice of law. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. Any dispute requiring judicial proceedings shall be brought before the Italian courts, without prejudice to the right of EU consumers to seek redress before the courts of their country of habitual residence.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or via a notice on the platform at least 30 days in advance. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Upslang with respect to the Service and supersede all prior or contemporaneous agreements, representations, or understandings.
Severability
If any provision of these Terms is found by a competent court to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force and effect.
Language
These Terms are provided in English. In the event of any inconsistency between a translated version and the English version, the English version shall prevail.
Force Majeure
Upslang shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, infrastructure outages, third-party service failures, or governmental actions. We will make reasonable efforts to restore the Service and notify affected users.
